Halle Berry refutes ex-husband Olivier Martinez’s claims of child abuse against their 13-year-old son, Maceo, as they approach a court hearing on Oct. 16 regarding custody and a restraining order.
Martinez is requesting full legal and physical custody of Maceo and a restraining order against Berry, alleging violence towards their son on Sept. 26, with a documented history of abuse. A temporary restraining order was granted on Oct. 1, limiting Berry’s contact with Martinez and Maceo until the hearing, while the court dismissed the request to monitor Berry’s sobriety due to insufficient evidence.
Berry denies the accusations, labeling them as “completely untrue,” asserting she has never harmed Maceo in any way. She characterizes the Sept. 26 incident as playful roughhousing that escalated into an argument and seeks a return to their previous 50-50 custody agreement.
The couple, who married in 2013 and finalized their divorce in 2023, had a joint custody arrangement after their son, Maceo, was born.
Martinez filed for a restraining order and sole custody on Oct. 1, citing the alleged abuse incident on Sept. 26. Berry’s 18-year-old daughter, Nahla, defended her mother’s character in a declaration, affirming she has never witnessed any physical mistreatment of Maceo by Berry.
Berry’s legal team disputed Martinez’s claims, highlighting past legal issues concerning their son’s welfare and presenting video evidence that contradicts Martinez’s version of events. Berry directly refuted the allegations on Oct. 5, detailing her account of the Sept. 26 incident and emphasizing her commitment to non-violence.
The upcoming hearing on Oct. 16 will determine the continuation or alteration of the temporary restrictions imposed on Berry.
