The Yukon Court of Appeal has rejected an appeal from a man challenging his sentence for sexual assault. Rudra Amin, now residing in Calgary, was convicted in 2023 of assaulting three women in Whitehorse between 2017 and 2018. The victims reported the incidents in 2020. A jury trial found Amin guilty of four counts of sexual assault.
Following his sentencing, Amin promptly lodged an appeal and was subsequently granted bail. In his appeal, Amin sought a reduction of two months from his slightly over two-year sentence to qualify for a conditional sentence order, citing concerns about potential immigration repercussions.
In a ruling issued on August 6, Justice Susan Griffin dismissed the appeal, refuting Amin’s argument that the initial judge had erred during sentencing. Griffin also determined that Amin’s plea for a conditional sentence was unsuitable. She emphasized that unless Amin could demonstrate a fundamental sentencing error, his request to abbreviate his sentence by two months was unwarranted.
Griffin’s decision stated, “This is simply tinkering and not this court’s proper role.” Consequently, Amin is required to serve his original sentence of slightly over two years.
