A man from Kidderminster, identified as Luke Davis, has been publicly pictured today after receiving a prison sentence of four years and six months for intentionally infecting a sexual partner with HIV. The court found Davis guilty of causing grievous bodily harm to the victim due to his reckless decision not to disclose his HIV-positive status or adhere to medication that could prevent the virus’s transmission.

Despite being diagnosed with HIV in August 2017, Davis neglected medical advice to attend regular check-ups and take prescribed medication. Subsequently, he failed to inform his sexual partner about his condition. Tests later revealed that the victim had contracted the same strain of HIV present in Davis’s bloodstream.

During the trial at Hereford Crown Court, it was disclosed that Davis discontinued medical appointments in 2018 and ceased medication delivery in 2019. The victim only discovered their HIV-positive status during a routine screening in 2021, prompting them to report the incident to authorities. The victim expressed the profound impact of living with HIV, attributing it to Davis’s irresponsible actions and negligence.

At the sentencing hearing, Judge Jackson condemned Davis’s selfish behavior, stating that he deliberately withheld his HIV diagnosis, endangering his partner. Despite investigations revealing Davis had multiple sexual partners, no additional victims have been identified thus far.

Speaking on behalf of the Crown Prosecution Service, Giovanni D’Alessandro characterized Davis as reckless and selfish, emphasizing the irreversible harm caused by his actions. D’Alessandro highlighted that Davis had the necessary medication to control the virus but chose to discontinue treatment, leading to the transmission of HIV to the victim.

Detective Superintendent Gerard Smith of West Mercia Police commended the victim for reporting Davis and enduring the complexities of the investigation. Smith emphasized the importance of the sentencing in holding Davis accountable for the victim’s lifelong medical treatment resulting from his reckless conduct. The authorities hope that this case serves as a deterrent against similar dangerous and irresponsible behavior.
