Daughter Testifies Against Abusive Partner in Fatal Assault

The courageous daughter of a disabled woman who was fatally assaulted by her abusive partner has recounted her harrowing experience in court. Robert Karl Huber, aged 69, repeatedly subjected his partner Lindy ‘Kimmy’ Lucena, aged 64, to physical violence during their five-year relationship before ultimately causing her death on January 3, 2023, in Ballina, New South Wales, Australia.

Under the influence of alcohol and sedatives, Huber viciously attacked Lucena, resulting in severe injuries. Lucena’s daughter emotionally detailed in the NSW Supreme Court how her mother’s body bore the brunt of the brutal assault, leaving her unrecognizable.

She expressed her deep sorrow over the devastating loss of her mother, emphasizing that while losing parents is a natural part of life, losing a mother to such pure evil is incomprehensible. Despite not succumbing directly to her injuries, the court ruled that the beating significantly contributed to Lucena’s death, compounded by underlying health conditions.

Huber’s controlling and abusive behavior towards Lucena, exacerbated by her cognitive and physical limitations following a stroke, was highlighted during the trial. Despite expressing remorse for the events leading to Lucena’s death, Huber’s denial of the extent of his violence was deemed dishonest by the judge.

Justice Rothman emphasized Huber’s lack of accountability for his actions, noting his extensive criminal history and previous breaches of domestic violence orders. Huber was sentenced to twelve years and nine months in prison, with a possibility of parole in October 2032.

The sentencing opens the door to further investigation into Lucena’s death and the law enforcement response to the assault.
